CPZs - a poke in the eye for Ealing Council

Linda has won her appeal against a PCN issued in Northfields in July, not because the adjudicator accepted her argument,it never got that far, but because the wrong ticket was issued. How many more incorrect tickets have been issued and paid unknowingly?"The PCN supplied by the Authority was issued under The Road Traffic Act 1991 and not, as it should have been , The Traffic Management Act 2004"All that took six months, a forest of trees with all the paper work back and forward, plus paying the staff. Also sent Linda a leaflet to claim for any expenses - now how much can we claim???

Great news, and thanks for letting us know.  The fact that PATAS are asking for details of any expenses suggests that they might be about to make an order for costs against Ealing, which they would only do "where the authority’s behaviour is found by the Adjudicator to have been ‘frivolous, vexatious or wholly unreasonable’." A fine of £15,000 was recently levied against a Council in East London in recompense for the distress caused to a man who received four tickets.The man seems to have brought the prosecution privately and the award was made because the Council didn't present themselves on court day. They claim they never received the summons. They are refusing to pay and are contesting the judgment.
